EmptySpace / marketplace rules
Terms and conditions
These are the rules for using EmptySpace as a shipper or driver in Canada. Read them before posting or accepting a shipment.
1. Who may use EmptySpace
EmptySpace is a marketplace for shipments that start and end in Canada. You must be legally able to enter a binding agreement, provide accurate account information, and keep your account secure. Do not share your sign-in details or use another person's account.
Drivers must hold the licences, registration, insurance and permissions required for their vehicle, cargo and route. You must keep those documents current. Verification on EmptySpace is not a guarantee of identity, safety, insurance coverage or legal compliance.
2. Strictly prohibited shipments
Do not list, offer to carry, or transport anything illegal, stolen, counterfeit, hazardous, explosive, flammable, radioactive, infectious, or otherwise unsafe. Firearms, ammunition, controlled drugs, live animals, human remains, cash, negotiable instruments and goods requiring special permits or temperature control are prohibited unless EmptySpace expressly authorizes them in writing and the transport is lawful.
The active prohibited-items list shown in the app also applies. If an item is restricted by law, your insurer, your vehicle's limits, or a carrier's rules, it is not allowed even if it is not named in that list. EmptySpace may remove a listing or suspend an account when safety or legality is in question.
3. Shipper obligations
Describe every item honestly, including its condition, dimensions, weight, quantity, value, packaging, pickup and delivery details, and any handling needs. Package items safely, disclose fragile or high-value goods, and be present or arrange an authorized person for pickup and delivery. Do not conceal contents or ask a driver to exceed vehicle capacity.
You are responsible for having the right to ship each item and for providing lawful pickup and delivery access. The price and timetable offered by a driver depend on the accuracy of your listing.
4. Driver obligations
Only accept shipments you can lawfully and safely carry within your vehicle's remaining weight and space limits. Secure cargo, obey traffic and transport rules, maintain your vehicle and insurance, and keep the shipper informed of material delays. Do not hand a shipment to an unauthorized third party or change the agreed destination without the shipper's consent.
Record pickup and delivery truthfully. Upload genuine pickup and delivery photos as proof and do not mark a shipment delivered before it reaches the agreed recipient or location. Never share your location through the app while not transporting an active shipment.
5. Booking, payment and disputes
A shipment is booked when the shipper selects a driver's offer. The checkout shows the actual deposit, balance and applicable charges before payment. Pay only through the app's available checkout; do not request or make off-platform payments for a booking. A balance becomes payable after delivery is recorded, and a shipper should review delivery proof before confirming completion.
If something goes wrong, contact the other party through the booking and report the issue promptly in EmptySpace. Do not knowingly submit false claims, fabricated evidence, or retaliatory ratings. Refunds, chargebacks and driver payouts depend on payment status and applicable payment-provider rules; a booking is not insurance against loss or damage.
6. Conduct, privacy and enforcement
No harassment, threats, discrimination, fraud, impersonation, spam, attempts to bypass access controls, scraping, or misuse of another person's details or documents. Use contact and location information only to complete the relevant shipment. Do not publish private documents or proof photos outside the booking.
EmptySpace may investigate reports, restrict listings, withhold access to marketplace features, or suspend accounts for suspected rule violations or safety concerns. We may preserve records needed to investigate disputes or comply with legal obligations. These rules do not remove rights or remedies that cannot legally be excluded under applicable Canadian law.
